Buyer’s Checklist: Benahavís & Costa del Sol


Buying a home in Benahavís or on the Costa del Sol is an exciting step, but it can feel unfamiliar if you’re navigating the Spanish system for the first time. This checklist is designed to guide you calmly through the process — from early preparation and viewings, right through to completion and ownership — so you always know what to expect next.

Before Viewing

The preparation stage is where a smooth purchase really begins. Taking a little time to organise things before you start viewing properties will help you move quickly — and confidently — when you find the right home.

Start by clarifying what matters most to you: the area, type of property, budget and lifestyle priorities, whether that’s golf access, sea views, village living or privacy. At the same time, it’s important to understand your buying power. If you’re financing the purchase, mortgage pre-approval can save valuable time. Cash buyers should also plan how funds will be transferred into Spain.

You’ll also want to budget realistically for total purchase costs. In Andalucía, buyers should typically allow around 10% on a resale property or 12–13% on a new build — details we explain fully in our Purchase Costs Guide.

  • Choose an independent lawyer experienced in Andalusian property law
  • Apply for, or plan to obtain, your NIE number
  • Prepare proof of funds, as Spanish banks and notaries may request this
  • If you’re non-EU, review residency routes such as the Digital Nomad or Non-Lucrative visas

During Viewing

Viewings are about much more than ticking boxes. They’re your opportunity to understand how a property actually feels — how the light moves, how private it is, and how it fits into daily life.

Bring identification, as many gated communities require it for access, and take your time making notes or photos. Pay attention to orientation, noise levels, parking, storage and overall condition, as these details are easy to forget after several viewings.

It’s also the right moment to ask practical questions. Community fees, local taxes and running costs can vary by development, although Benahavís benefits from a fixed €18 annual rubbish charge and some of the lowest IBI rates in the region.

  • Confirm what’s included in the sale — furniture, appliances, parking and storage
  • Ask about any planned improvements or renovations
  • Explore nearby amenities, schools, golf courses and access routes
  • Discuss rental potential, subject to community rules and VFT regulations

Offer & Reservation

Once you’ve found the right property, things can move quickly. This stage is about securing the home while your lawyer carries out essential legal checks.

A reservation agreement is usually signed first, typically with a payment of €6,000–€10,000. This removes the property from the market while due diligence is completed. Provided legal issues don’t arise, the purchase then progresses to a private contract and final completion.

  • Ensure your lawyer reviews title, debts, licences and community compliance
  • Agree clear timelines and payment milestones
  • Pay deposits via a lawyer’s client account or developer escrow
  • Request key documents such as the Nota Simple and energy certificate

Completion & Handover

Completion takes place at the notary, where ownership officially transfers. If you’re unable to attend in person, this can usually be handled through a Power of Attorney.

Your lawyer will coordinate fund transfers, tax filings and registration after signing. Once complete, utilities and community charges are switched into your name, and you’ll receive the keys and access controls for your new home.

  • Confirm tax payments are submitted promptly
  • Ensure utilities and community fees are updated
  • Receive your registered title deed once Land Registry updates are complete

After Purchase

Ownership brings a few final administrative steps, but once these are in place, you’re free to enjoy your property with confidence.

This includes setting up insurance, arranging direct debits and keeping a secure digital record of all key documents. If you plan to rent the property, we can also advise on tourist licensing where permitted.

  • Review ongoing ownership taxes and fees
  • Arrange appropriate insurance cover
  • Register locally if residing full-time
  • Maintain a digital folder with all documentation
